One is charged according to the text of a particular law. It is appropriate that an accused person should be found not guilty if the specifics of the allegation do not meet the specifics. 

NOTE: I did not use the term 'innocent' becauserequiring proof of innocence is not the intent of American legal system, which requires 'proof of guilt beyond reasonable doubt'. Proving innocence is a very very challenging scenario as it requires disporoving all evidence of wrongdoing, significant or otherwise.
